Big day today for five-for-five eligibility rule litigation: it's oral argument day at the Tenth Circuit Court of Appeals for the class action lawsuit, Wisne v. NCAA.
This is the federal lawsuit that challenges the NCAA's decision to exclude the Class of 2022 under antitrust law. It's the case that produced an injunction that made the entire Class of 2022 eligible before the injunction was stayed.

Per Sam C. Ehrlich Associate Professor, @BoiseStateCOBE lawyer
What happens if the NCAA wins?
The current environment will largely stay put. There will be no class-wide injunction (unless a new one is granted by the district court later). However, to be clear, this decision will NOT affect any injunctions granted by other courts.
What happens if the players' win?
The injunction will be restored, and all Class of 2022 athletes will be eligible. Of note, however: this injunction explicitly did not cover rules regarding professional status or transfers; all that would have to be worked out later.
The NCAA could petition for en banc review, i.e., where the entire court hears the case rather than just a three judge panel. It could also petition the Supreme Court for emergency relief.

Tuesday 10/13 Court testimony 10th circuit
I asked a ref if he could give me a technical foul for thinking bad things about him. He said, of course not. I said, well, I think you stink. And he gave me a technical. You can't trust em.

Having just listened to the oral argument in Wisne v. NCAA at the 10th Circuit, I think the NCAA will win 3-0 and it won't be close. With attorney Rakesh Kilaru arguing for the NCAA, the NCAA had a great day in court. The nationwide injunction is highly likely to be reversed IMO.

After DeWine signs EO the Supreme Court of Ohio
Paul Fritschner @PaulFritschner
BREAKING: The Ohio Supreme Court has stayed the decision by the First District Court of Appeals.
The players that are part of the Ohio 5-in-5 lawsuit are eligible while more information is collected from both parties.

Is Filip eligible? We really need based on what I saw last week. An extra wing will help spread court and bring up the ball since Westry seemed scared to attack the press.

He is in Tennessee and for now eligible.
I'd like to see more states do something similar to what Ohio did, because the NCAA would have to litigate on multiple fronts, which might prompt them to change their policy.

Where are the Legal Eagles' two cents?
The Governor's actions seem to be grandstanding. The Ohio SC seems to be treading water until a federal court speaks. All the while, Borovicanin and others twist in the wind. Even though Borovicanin didn't have a normal Borovicanin game against Tennessee, he did contribute rebounding, which is something X needed last year, and won the game last night, outrebounding a decent team in Tennessee
