Tuesday 10/13 Court testimony 10th circuit

Big day today for five-for-five eligibility rule litigation: it's oral argument day at the Tenth Circuit Court of Appeals for the class action lawsuit, Wisne v. NCAA.
This is the federal lawsuit that challenges the NCAA's decision to exclude the Class of 2022 under antitrust law. It's the case that produced an injunction that made the entire Class of 2022 eligible before the injunction was stayed.

What happens if the NCAA wins?
The current environment will largely stay put. There will be no class-wide injunction (unless a new one is granted by the district court later). However, to be clear, this decision will NOT affect any injunctions granted by other courts.
What happens if the players' win?
The injunction will be restored, and all Class of 2022 athletes will be eligible. Of note, however: this injunction explicitly did not cover rules regarding professional status or transfers; all that would have to be worked out later.
The NCAA could petition for en banc review, i.e., where the entire court hears the case rather than just a three judge panel. It could also petition the Supreme Court for emergency relief.
